In this environment, a company that invests heavily in robust bias auditing and privacy-by-design may find itself at a disadvantage against a competitor that cuts corners. This isn’t a sustainable or fair model. It punishes the responsible.
A clear, federal regulatory framework doesn’t hamper innovation; it creates the “level playing field” we Canadians so often champion. It ensures that competition happens on the basis of quality and utility, not on who is willing to take the biggest ethical shortcuts.
The Tangible Case for a Made-in-Canada AI Framework
Beyond the principles, there are concrete, bottom-line reasons why Canadian business leaders should be advocating for smart regulation.
First, consider legal certainty. Imagine an AI system used in our healthcare system makes an error in a diagnosis, or an automated lending tool in one of our banks disproportionately denies mortgages in certain neighbourhoods. Under our current patchwork of provincial and federal laws, who is liable? This legal ambiguity is a minefield. Finally, there’s global interoperability. The EU is implementing its AI Act. The U.S. is grappling with a state-by-state approach. Canada has a unique opportunity to not just follow, but to lead. We can craft a framework that is both principled and pragmatic, one that other mid-sized economies can model. If we don’t act decisively, we will be forced to comply with standards set by other blocs, potentially putting our homegrown AI sector at a severe disadvantage.
What Pragmatic, Canadian Regulation Should Look Like
